Padilla refiles lawsuit after US Supreme Court decision
Jeannie Shawl at 3:18 PM ET

An attorney for Jose Padilla, who is accused of participating in an al-Qaeda plot to set off a radiological "dirty" bomb in the US, has refiled his lawsuit against the federal government. The US Supreme court dismissed Padilla's case last week on jurisdictional grounds without deciding whether President Bush had the authority to designate Padilla as an enemy combatant or whether indefinite detention without charges or trial violated Padilla's constitutional rights.
