Massachusetts state law limiting out-of-state marriages challenged

An attorney for eight out-of-state same-sex couples has asked a Massachusetts court for an injunction blocking the state from enforcing a 1913 state law, which bars marriages in Massachusetts that would be illegal in a couple's home state, saying that the 1913 law is discriminatory and violates both the US Constitution and Massachusetts state law. Superior Court Judge Carol Ball has not yet made a decision, but said "from what I've read so far, it appears the state is applying the law in a procedurally nondiscriminatory manner."
