In a decision handed down this morning, the US Supreme Court has held that a California state court acted reasonably when it failed to consider a defendant's age and inexperience when determining whether the defendant was "in custody" for
Miranda purposes. The case is
Yarborough v. Alvarado (case backgrounder from Duke Law School's Program in Public Law). Cornell's Legal Information Institute has posted today's
opinion per Justice Kennedy, along with Justice O'Connor's
concurrence and Justice Breyer's
dissent.
The Supreme Court did not grant any petitions for
certiorari Tuesday. The Court's full Order List is available
here (via Cornell's Legal Information Institute).
