BREAKING NEWS ~ Supreme Court dismisses challenge to Pledge of Allegiance
Jeannie Shawl at 10:35 AM ET

CNN is reporting that the US Supreme Court has dismissed the challenge to the constitutionality of the Pledge of Allegiance on a technicality.

UPDATE: In Elk Grove Unified School District v. Newdow (case backgrounder from Duke Law School's Program in Public Law), the Supreme Court held today that atheist Michael Newdow did not have standing to sue on behalf of his daughter because he does not have sufficient custody to qualify as her legal representative. The court did not address whether a reference to God in the Pledge of Allegiance violates the constitutional separation of church and state. AP has more.

UPDATE 2: Cornell's Legal Information Institute has posted today's opinion per Justice Stevens, along with Chief Justice Rehnquist's concurrence, Justice O'Connor's concurrence and Justice Thomas' concurrence.
