Federal challenge brought against gay marriage in Massachusetts
Jeannie Shawl at 2:05 PM ET

Liberty Counsel and other conservative groups have filed a motion in federal court seeking to block the legalization of gay marriage in Massachusetts after similar attempts filed in state court have failed. The motion argues that the Supreme Judicial Court of Massachusetts, by changing the state's marriage laws, usurped the constitutional powers of the legislature and governor, which violates the US Constitutional guarantee of a uniform separation of power in all the states.
